Terms and Conditions
  1. Introduction
  • Destination Kiama (Kiama Municipal Council) is giving one person the chance to win a SUP Shellharbour Experience for 2 people (valued at $90).
  • Information on how to enter the “Destination Kiama X SUP Shellharbour’s Visitor Centre Competition” (“Promotion”) and the prize(s) form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions (“Terms and Conditions”).
  • Any questions regarding the competition should be directed to belinda.williams@kiama.com.au.
  1. Eligibility
  • Entry is only open to Australian residents aged 18 years.
  • Employees (and their immediate families) of Kiama Council (the “Promoter”) and businesses associated with this promotion are ineligible to enter. Immediate family includes spouse, exspouse, defacto spouse, child or stepchild, parent, stepparent, grandparent, stepgrandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin, and includes a spouse thereof. The Promoter will determine eligibility at its absolute discretion.
 Promotional Period
  • The Promotion commences at 9:00am on Monday 16 September 2024 and closes at 5pm AEST on Sunday 3 November 2024 (“Promotional Period”).
  1. How to Enter
  • Entry in the Promotion is via the iPad entry form which will be displayed at the Kiama Visitor Centre. To enter, individuals must complete the form in full and press submit.
  1. Prize
  • The prize for the competition is:
    • 2 x Group SUP experiences (valued at $45 each or $90 total)

  • Bookings are subject to business occupancy and availability.
  • The booking of these items is the role of the prize winner.
  • The prize is non-transferable, non-exchangeable, and no cash alternatives will be offered.
  • Destination Kiama reserves the right to substitute the prize with another of equivalent value without giving notice.
  1. Entry Conditions
  • Only one (1) entry per email address is permitted (“Entry”).
  1. Entrant Warranties and Consents
  • By entering into this Promotion the entrant confirms and warrants the following:
(a) The Entrant consents to the use of their personal information in relation to the Promotion for the purposes of facilitating the awarding of the prize, notifying all competition entrants. (b) The Entrant’s email address will be added to Destination Kiama’s e-newsletter list and SUP Shellharbour’s e-newsletter list from which they can unsubscribe at any time. (c) All required permissions regarding the Entry have been obtained by the Entrant. (d) The Entrant grants the Promoter a nonexclusive perpetual licence to use the Entrant’s name for announcement purposes.
  1. Verification and Disqualification
  • The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process, or engaged in any unlawful or improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion.
  1. Incomplete and Invalid Entries
  • Incomplete entries will be deemed invalid and rejected. The Promoter reserves the right to disqualify any entry that it reasonably believes is prohibited by these Terms and Conditions, any relevant law, or is otherwise deemed inappropriate.
  1. Disputes and Proof of Entry
  • If there is a dispute as to the identity of an entrant, the Promoter reserves the right to determine the identity of the entrant. The Promoter reserves the right to request the winner to provide proof of identity and/or proof of entry validity in order to claim the Prize. In the event that a winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered.
  1. Responsibility and Liability
  • The Promoter accepts no responsibility for any late, lost, or misdirected entries not received by the Promoter or delays in delivery due to technical disruptions, network congestion, or any other reason.
  1. Winner Selection
  • This competition is a game of chance
  • The winner will be selected at random from all eligible entries received during the competition period.
  • The draw will take place on Monday, 4 November 2024, at 11 Manning Street, Kiama.
  1. Winner Notification and Prize Claim
  • The Promoter will endeavour to contact the winner(s) using the details provided within seven (7) business days of the selection. If the winner(s) cannot be contacted by 11 November 2024, or cannot accept the Prize, the Prize will be forfeited, and another random entry will be awarded the Prize until a valid winner is contacted. Any winner determined in accordance with this clause will be notified in writing.
  1. Prize Conditions
  • The prize voucher is valid for 3 years.
  • Booking and reservations associated with the prize are subject to business availability.
  • The booking of these items is the role of the prize winner.
  • The prize is nontransferable, nonexchangeable, and no cash alternatives will be offered.
  • Destination Kiama reserves the right to substitute the prize with another of equivalent value without notice.
  • Winners are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with redelivery of a prize, should the delivery details provided by a winner be incorrect.
  • If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a prize of equal value.
  • If the winner(s) does not take the Prize by the time stipulated by the Promoter, the Prize will be forfeited.
  • Total prize pool is valued up to AUD$90.
  • The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash. The Prize cannot be varied.
  • The Prize will be awarded to the person(s) named in the Entry.
  1. Entrant Responsibilities
  • Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  1. Promotion Modification and Cancellation
  • If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to modify, suspend, terminate, or cancel the promotion, as appropriate.
  1. Additional Costs and Liabilities
  • Any cost associated with booking this prize, including accommodation, transport, additional activities, and food, will be the responsibility of the winner.
  • Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its officers, employees, and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of:
(a) Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control). (b) Any theft, unauthorised access, or thirdparty interference. (c) Any entry that is late, lost, altered, damaged, or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter. (d) Any variation in Prize value to that stated in these Terms and Conditions. (e) Any additional costs incurred by a winner. (f) Taking/use of and/or participation in the prize.
  1. Outside Interference
  • Kiama Municipal Council may in its absolute discretion, but subject to State and Territory laws, modify, suspend, cancel, recommence or extend this competition as appropriate if:
    • for any reason, this competition is not capable of running as planned due to technical, hardware or software failures or interferences, or changes to third party sites or platforms, which affect the administration, operation, security, fairness, integrity or proper conduct of the competition;
    • the level of interest or participation in the competition is insufficient or there has been some delay in commencing the competition; or
    • the entry procedure, determination of winners or delivery of prizes is prevented hindered or affected by any external agent or event beyond the reasonable control of Kiama Municipal Council.
  1. Technical Issues
  • If for any reason this Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify, or suspend the Promotion, subject to any written direction given under any relevant laws.
  1. Privacy and Personal Information
  • The Promoter collects personal information (“PI”) to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and prize suppliers, and as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.kiama.nsw.gov.au/Council/CouncilPolicies/PrivacyManagementPolicy. In addition to any use outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant.
